TERMS AND CONDITIONS Please Note: These terms and conditions will only become active when Langtoft.Net is launched and you sign up as a Subscriber. Section 1. The Langtoft.Net Broadband Internet Service - hereinafter called 'The Service'. 1.1 The service provides you with access to the Internet and the range of Internet services and applications that are described on the website www.langtoft.net. 1.2 The service is provided to you ONLY at the premises specified during the order process ('Your Premises'). The service cannot be sub-let to any other premises or individual under any circumstances. If you have two (or more) premises you will require two or more connections. Please contact Langtoft.Net for precise details of exclusions to this condition. Section 2. Your Contract with Langtoft.Net. 2.1 To sign up for The Service send an email via www.langtoft.net or telephone on 01377 267426. The contract only begins once you have personally signed a copy of this agreement and payment details have been arranged. You will then become a Langtoft.Net 'Subscriber'. 2.2 Please note that Langtoft.Net reserve the right to alter these terms and conditions without prior notice to Subscribers. The latest copy will always be available by clicking the 'subscribe' button on the Langtoft.Net home page. Section 3.0. Arranging your connection. 3.1 Before we can provide you with The Service we will need to carry out the following: (a) A complete site survey. This will ensure that your premises can receive the necessary signal to connect to our base station. It will also reveal whether any additional equipment - for example a larger aerial - will be required by your village location, and therefore whether there will be any additional costs involved in setting up your connection. (b) Once we have successfully completed a survey we will provide a fixed cost quotation. (c) If you are satisfied with the costs indicated and wish to become a Langtoft.Net Subscriber we will then ask you to sign a copy of these details and to provide payment for the installation costs and first month’s subscription. (d) We will then arrange a date to carry out the installation of the equipment hardware and software as detailed in the quotation provided. 3.2 We will make all reasonable efforts to activate the service by the date agreed with you; however it should be noted that all dates are estimated and we can not guarantee that installation will take place on that date. 3.3. If it is not possible to provide the service due to a technical difficulty we will notify you as soon as possible. We will also keep your details on record and contact you further once that difficulty has been overcome. Section 4. Equipment and Installation. 4.1 Please note that any equipment installed at your premises will only become your property and responsibility upon payment of the installation charge. We will be pleased to provide advice on a suitable location for any equipment purchased from Langtoft.Net. 4.2 To ensure that the service remains safe and secure, any equipment connected to or used with The Service must bear the European Consumer Equipment Standards "CE" mark and must be used in compliance with all relevant instructions and safety and security procedures. 4.3 PLEASE NOTE that Langtoft.Net its owners and staff can not be held responsible for any damage to your premises or injury to residents arising from the installation or use of Langtoft.Net equipment howsoever caused. Langtoft.Net installations are carried out at the property owner’s risk. If you are not the owner of the premises Langtoft.net will require a written installation agreement signed by the owner of the premises or their agent before any installation works can be started. 4.4 In order to activate The Service we will have to install hardware and software on your PC and may have to alter some of the settings of your PC. Whilst we will ensure to the best of our ability that your PC is fully functioning upon completion of the installation, no responsibility will be accepted for any data lost or damaged during this process. 4.5 Title in any equipment and software installed by or provided by Langtoft.Net to Subscribers remains with Langtoft.Net until payment in full has been received. Once payment has been received the safety and condition of the equipment fitted and software provided becomes the sole responsibility of the Subscriber. 4.6 From time to time Langtoft.Net or our agents may require access to your premises to carry out necessary repairs, maintenance or upgrades. If access is required, we will provide as much advance notice as possible. Please ensure that any callers claiming to be from Langtoft.Net provide suitable and appropriate identification. If you are not satisfied DO NOT ALLOW ACCESS, but contact Langtoft.Net on 01377 267426 or 0796 880 2733 immediately. By becoming a Langtoft.Net subscriber you agree to allow us all reasonable access. Section 5. Security Issues. PLEASE READ THIS SECTION CAREFULLY! 5.1 Langtoft.Net supports the following security protocols: (a) WEP (b) MAC ADDRESS (c) 802.1x Radius 5.2 If we consider that there has been or there is likely to be a breach of security or misuse of the service Langtoft.Net reserves the right to: (a) Change your WEP key remotely. If this is necessary we will notify you of your new log on details. (b) Disconnect your service until such time as the security breach on your connection has been resolved. This will only be done in the most extreme of circumstances. 5.3. Langtoft.Net reserves the right to bar the username and/or password of any subscriber that breaks these terms and conditions. In such circumstances re-connection of the service will be at the discretion of Langtoft.Net. Please note that a re-connection fee may be payable. 5.4 Langtoft.Net reserves the right to permanently bar any individuals or bodies that attempt to gain access to The Service unlawfully or without becoming Langtoft.Net subscribers. 5.5 Langtoft.Net reserves the right to permanently bar any individual or body that use the service for any unlawful purpose. See section 8 below for further details. Section 6. Service, Repair and Maintenance. 6.1 We may need to temporarily suspend the service for operational reasons (e.g. for planned maintenance, repairs or upgrades), in which case we will give you as much advance notice as possible by email. We will ensure that service is restored as soon as possible after any suspension. 6.2 For operational reasons we may need to alter your code or access details or other technical specifications associated with the service. Where necessary we will provide as much notice as possible. 6.3 Experience has shown that our service provider is very reliable. Although we attempt to provide you with the best possible service, we cannot guarantee that The Service will never become faulty. Langtoft.Net undertakes to correct all reported service faults within 48 hours of receipt of fault report. Equipment faults will be corrected as soon as new equipment can be obtained. Section 7. Charges. 7.1 Charges for first installation and/or any subsequent equipment you purchase from Langtoft.net must be paid for at time of order. 7.2 When you register for the service, we will ask you to sign a direct debit mandate instructing your bank when and how much to transfer to Langtoft.Net. Please contact langtoft.Net for further information. 7.3 Monthly Subscription Charges will take place in advance on a calendar month basis. For example payment for the period 1st May to 1st June will be drawn on or just before the last day of April. A full year’s subscription will be twelve equal payments. 7.4 Langtoft.Net reserves the right to charge £50 plus VAT for callouts in the following cases: (a) When entry to your premises is refused for no reason or no access can be gained at the appointed time as agreed between the Subscriber and langtoft.Net engineers. (b) When a reported fault is due to miss-use of The Service or equipment. (c) When equipment supplied by Langtoft.Net requires replacement once outside the manufacturers warranty period. (d)Where the fault is due to a malfunction of the subscribers PC or changes made by the subscriber to the PC or any other equipment connected to the PC. Section 8. Use of the Langtoft.Net Service. Please read this section carefully. 8.1 Langtoft.Net. Net, as a provider of this service will bear no legal responsibility whatsoever for any legal or criminal liability incurred by the subscriber, or any other person making use of the subscribers equipment. The Subscriber must take all reasonable precautions to ensure that nobody including the Subscriber makes use of the service: (a) To Commit Fraud or in connection with a criminal offence; (b) To knowingly send, receive, upload, download, use or store any material which is offensive, abusive, indecent, defamatory, obscene, or menacing. (c) To breach copyright, confidence, privacy or any other intellectual rights; (d) To cause annoyance, inconvenience, anxiety, harassment, alarm or distress; (e) To transmit or allow to transmit 'spam' or unsolicited advertising or promotional material or to knowingly to receive responses to any spam, unsolicited advertising or promotional material sent or provided by or on behalf of any third party; (f) In any way which is or could be construed to be detrimental to the provision of the service to any Subscriber; (g) In a way that does not comply with the instructions provided to the Subscriber by Langtoft.Net. 8.2 Software provided to Langtoft.Net Subscribers may not be copied or modified in any way unless allowed by law. Subscribers undertake to access the Langtoft.Net Service only via use of the software provided, or in an alternative way permitted by Langtoft.Net. 8.3 As a Subscriber to the Service you undertake to contact Langtoft.Net immediately you suspect that any security has become breached or of any unlawful use of The Service by any person, individual or body. 8.4 Any changes made to the information provided when signing up for The Service, including any changes to your payment details, the Subscriber must inform Langtoft.Net immediately. 8.5 If you move to different premises in The Service reception area you may be able to take your connection with you. If you sell your premises or a new tenant takes over your premises a new agreement with Langtoft.Net will be required. Please contact Langtoft.Net for full details. 8.6 Langtoft.Net can not be held responsible for data loss howsoever caused. 8.7 It is the responsibility of every subscriber to use regularly updated anti-virus software, and firewall software. Once again, experience has shown that our service provider’s equipment deals effectively with most viruses and malicious software. Whilst every effort is made to ensure that The Service remains free from computer viruses Langtoft.Net can not be held responsible for damage by or loss of data due to virus infection howsoever caused. 8.8 It is the responsibility of Subscribers to ensure that all users of The Service browse the internet responsibly and that due supervision is given to users of a vulnerable age. Section 9. Web space 9.1 Web space provision for Langtoft.Net subscribers is not yet confirmed. It is our intention to provide web space for subscribers; please watch the Langtoft.Net website for updates. Section 10. You’re Internet Use 10.1 The Langtoft.Net Service enables you to access the Internet. The Internet is separate entity from the Service, and use of the Internet is at your own risk and subject to any applicable laws. Langtoft.Net accepts no responsibility for any goods, services, information, software, or other materials obtained when using the Internet via the Langtoft.Net Service. Section 11. Breach of this Agreement. 11.1 Langtoft.Net reserves the right to suspend the Service or to terminate this agreement or both as follows: (a) With immediate effect if a Subscriber materially breaches this agreement; (b) With immediate effect if we believe that the service is being used in a way that directly or indirectly contravenes any of these terms or conditions even if the Subscriber is not party to the contravention. (c) Upon reasonable notice if a Subscriber fails to remedy a notified breach within a reasonable period of time. (d) With immediate effect if bankruptcy or insolvency, receivership, administration or liquidation proceedings are brought against the Subscriber or monthly subscription payments are not made on time. 11.2 If Langtoft.Net deems it necessary to suspend or terminate this agreement for any of the reasons contained herein the Subscriber will be informed as soon as reasonably possible and an explanation given as to why this action has been taken. 11.3 Langtoft.Net undertakes to restore the Service to a Subscriber once that Subscriber can provide reasonable proof that the reason for suspension or termination has ceased. Langtoft.Net may require a written undertaking from the Subscriber that no further breach will occur and that in future the terms of this agreement will be adhered to. 11.4 PLEASE NOTE that if this agreement is suspended this contract will continue during the period of suspension and all relevant charges will continue until such time that the Service is reinstated or will end if the agreement is terminated. 12.1 Liabilities. 12.1 Langtoft.Net its owners and staff will diligently and to the best of our abilities adhere to the terms and conditions set out in this agreement. 12.2 Langtoft.Net its owners and staff can not be held responsible for events that are outside our control. 12.3 As a subscriber you are protected under Part I of the Consumer Protection Act 1987 and by Langtoft.Net insurance. Section 13. Giving Notice. 13.1 Notice of intention to terminate this agreement must be given in writing by e-mail or post or delivered by hand to the address shown below and on the Contacts page of the Langtoft.Net website. Section 14. Unsupported Internet Applications. 14.1 Langtoft.Net WILL NOT SUPPORT FILE SHARING. 14.2 langtoft.Net does not recommend the use of the Service for Internet Gaming.
